General Terms and Conditions of Sale / GDPR

Article 1 – Scope of application of the general terms and conditions of sale
These general terms and conditions govern all sales of stays made on the website www.labuissonniere-lodges.fr. They form an integral part of any contract concluded between the campsite and its customers.
Each customer acknowledges having read these terms and conditions prior to booking any stay, for themselves and any person participating in the stay.
In accordance with applicable law, these general terms and conditions are made available to all clients for informational purposes prior to the conclusion of any contract for the sale of stays. They can also be obtained upon written request addressed to the establishment's headquarters.

Article 2 – BOOKING CONDITIONS

2.1 Price and regulations
The price of the stay is indicated in euros, including VAT. Please note that the tourist tax and eco-contribution are not included in the price.
A deposit of 50% of the rental amount is required upon booking for stays starting more than 30 days in advance; the full amount is required for stays starting less than 30 days in advance. A booking is only confirmed once the deposit has been received. A provisional reservation for which the deposit payment is not honored within 7 days is automatically cancelled without recourse.
The remaining balance of the reservation is due no later than 30 days before arrival and must be paid by check, bank transfer, or ANCV holiday vouchers, or by credit card. IBAN details will be sent by email for bank transfers upon request.
In the event of an inaccurate declaration by the lessee, this contract will be automatically terminated and the sums paid will remain the property of the lessor.
All rentals are registered to a specific person and cannot be transferred. The rental only becomes effective with our agreement and after receipt of the total amount for the stay and the booking fees.
For any unreported delay or no-show on the arrival day before 8:00 PM, the rental will become available 12 hours after the arrival date indicated on the booking contract. After this time, and in the absence of written notification, the reservation will be cancelled and the full payment for the stay will remain due to the establishment.

2.2 Reservation Modification
Any stay that has begun is due in full; there is no refund possible for early departure, whatever the reason.
No discount will be given for late arrival or early departure.

2.3 Cancellation
Any cancellation must be notified by mail or email.

2.3.1 Cancellation before the client's arrival by La Buissonnière Lodges
La Buissonnière Lodges reserves the right to cancel your stay if expected weather conditions (heavy rain, storms, strong winds, etc.) do not allow safe access to the accommodations.
La Buissonnière Lodges will offer to postpone the stay to a later date (subject to availability) or to refund the amounts already paid.
No compensation can be claimed.

2.3.2. Cancellation before the client's arrival due to the client
If you cancel 15 days or more before your scheduled arrival date, you will receive a full refund. If you cancel less than 14 days before your arrival date, the full amount of your stay will be charged.

La Buissonnière Lodges also reserves the right to refuse access to accommodations to any client who is under the influence of narcotics, medication, drugs or alcohol, which may impair their vigilance or alter their behavior.
In this case, the client will not be entitled to accommodation or any compensation.

2.3.3 Cancellation upon arrival of the client due to the client
If upon arrival the client refuses to access the accommodation due to vertigo, allergies (Yak wool) or claustrophobia for example, he will be relocated to a guest room or other accommodation if and only if availability allows. The cost of the stay remains payable to the establishment. No compensation can be claimed.

2.4 Withdrawal
The legal provisions relating to the right of withdrawal in the case of distance selling provided for by the Consumer Code are not applicable to tourist services (article L.121-20-4 of the Consumer Code).
Therefore, for any booking of a stay with the establishment, the client has no right of withdrawal. However, the client may purchase cancellation insurance in case of illness, force majeure, accident, or death.

2.5 Accommodation capacity

The number of people listed per accommodation in our rates corresponds to the maximum occupancy allowed, with infants counting as one person. This number cannot be exceeded for safety and insurance reasons. Renting accommodation implies full acceptance of the terms and conditions by both parties.

Article 3 – COURSE OF THE STAY

3.1 Arrivals and Departures
Check-in is from 4:00 PM to 7:00 PM, and check-out is before 10:00 AM, any day of the week. For arrivals after 7:00 PM, please contact us by email at contact@labuissonniere-lodges.fr to inform us of your delay. We will then provide you with instructions on how to collect your accommodation key. For late check-outs until 1:00 PM (subject to availability), a supplement of €30 will be charged.

3.2 Caution
A security deposit of €200 for Caravan, Cottage, Chalet Lodge, and Cabin accommodations, or €100 for Yurts, Bivouac Tents, and Kotas, will be required upon arrival via credit card authorization. This amount will be deducted in the event of any damage to your accommodation, as noted during the check-out inspection conducted after your departure. If we identify a problem, we will contact you within 48 hours to discuss it. If we do not hear from you, your credit card deposit will be forfeited. A €50 cleaning fee will be added if you do not leave the accommodation in a perfectly clean condition (sheets removed and folded, dishes washed and put away for accommodations equipped with them).

3.3 Departure
Any key return or vacating of the pitch after 10:00 AM will incur an additional charge of €30 (departure must be before 1:00 PM). Any request to extend your stay must be made at least 24 hours before your scheduled departure date.

3.4 Animals
Animals are not allowed in the establishment.

3.5 Internal Regulations
As required by law, you must adhere to our internal regulations, filed with the prefecture, displayed at our reception and in the accommodations, and a copy of which will be given to you upon request.

Article 4 – LIABILITY
The establishment declines all responsibility for damage to the camper's/caravanner's equipment which is caused by their own actions; insurance for your equipment in terms of civil liability is mandatory (FFCC, ANWB, ADAC…).

Article 5 – SAFETY INSTRUCTIONS DURING YOUR STAY
The client must have clothing suitable for forest adventure activities and that protects against the natural elements with which they will be in contact.
La Buissonnière Lodges accepts no responsibility for stains or snags on clothing.
• Smoking is prohibited in the accommodations. However, smokers may smoke on the terraces.
• It is strictly forbidden to throw cigarette butts outside of the ashtrays provided for this purpose.
• It is also forbidden to leave candles lit during the night and when the client is absent from the accommodation.
As La Buissonnière Lodges is a place of peace and quiet, shouting, yelling, and speaking too loudly are prohibited, especially during check-in and check-out times. Similarly, nighttime movements must be made quietly to respect the privacy of other guests. Violent behavior or behavior likely to provoke altercations is forbidden.
We reserve the right to deny access to accommodations to people who do not comply with these rules.
Children are under the full supervision and responsibility of their parents or their designated representatives.
• It is forbidden to consume alcohol, drugs or other products that could impair the customer's alertness or alter their behavior.
• It is strictly forbidden to throw anything from the top of the stilt house.
• It is forbidden to allow anyone who is not a guest into the accommodations (for obvious safety and insurance reasons). When a reservation includes multiple accommodations, guests are asked to respect the maximum number of people allowed in each accommodation. Access to accommodations that are not part of the rental agreement is prohibited.

Article 6 – APPLICABLE LAW
For hygiene, safety and legal reasons, PUBLIC PREMISES and RENTAL PROPERTIES are NON-SMOKING.
Application of decree No. 2006-1386 of 15/11/2006. Fine incurred of €68.
These general terms and conditions are governed by French law and any dispute relating to their application falls under the jurisdiction of the High Court or the Commercial Court of Tours.

PLEASE NOTE: As the accommodation offered is in the heart of nature, the client will be required to live for one or more nights with the other inhabitants of the forest, the animals & the insects.
Thus, certain inconveniences such as "natural noise nuisances such as singing, scratching, hooting…", or other types of "insect bites" may occur.
The client is asked to be understanding and to take these manifestations as an integral part of the service offered!

GDPR: (Effective May 25, 2018)
La Buissonnière Lodges is committed to ensuring that the collection and processing of your data, carried out from the Elloha portal coupled with our Hippocamp Hotel Management software, comply with the General Data Protection Regulation (GDPR) and the French Data Protection Act.

Information we collect:
We declare that the Personal Data collected was done so fairly and lawfully, for specified, explicit and legitimate purposes.

Processing of the consumer customer's Personal Data
We process personal data solely for the purposes of providing services to the establishment, and in particular for the following purposes:
• Purpose: Processing customer reservations and managing services ordered by the establishment
• Purpose of subsequent commercial communication
• Purpose of conducting statistical studies

Personal data may not, therefore, be subject to any operation other than those provided for in these provisions.
